General Terms and Conditions

On the one hand, IBIZA SUMMER VILLAS, S.L (hereinafter “IBIZA SUMMER”), a private limited company registered in Spain, with company number B57965170 with office located at Calle Riu Guadiana 52, Unit D, San Josep de Sa Talaia, 07817 Ibiza, Spain.

And, on the other hand, the user of the website hereinafter referred to as the CUSTOMER, who accesses the WEBSITE for information purposes and to contract the villas offered through the WEBSITE. The CUSTOMER hereby declares that he or she is an adult (at least 18 years of age) and has the legal capacity to be bound by this agreement and to use this WEBSITE in accordance with these General Terms and Conditions of use, which he or she fully understands and recognizes.

By using the WEBSITE, the CUSTOMER fully accepts all the General Conditions published on the IBIZA SUMMER VILLAS, S.L. website at the time of use, and in particular those regarding limited liability for both IBIZA SUMMER VILLAS, S.L. The CUSTOMER must carefully read the General Conditions each time a booking is made as they may have been modified since their last visit.

1. Definition

Ibiza Summer Villas is an independent company that works on behalf of the owner of the property. The contract is stipulated between the owner represented by Ibiza Summer and the tenant.

You, our customer, when there is more than one of you, are each responsible for all obligations for the properties in full. The customer by making a deposit payment is deemed to have confirmed the contract and to have accepted these terms and conditions.

You agree to pass on these General Terms and Conditions to all members of your party, as they govern the property rental and everyone in your party. Booking Terms and Conditions are subject to change without notice. The Property Management Company may at any time modify any relevant terms and conditions, policies or notices. You acknowledge that by visiting the website from time to time, you shall become bound to the current version of the relevant terms and conditions (the “current version”) and, unless stated in the current version, all previous versions shall be superseded by the current version. You shall be responsible for reviewing the then current version each time you visit the website.

2. Booking

When making a booking,  you, our customer, are required to pay 50% of the rental price. This deposit payment needs to be received within three days of booking to secure the villa. All our prices are quoted in Euros however we, the company, may invoice you in Pounds Sterling at our discretion.

Once this 50% booking deposit is received, we will issue you with a booking confirmation via email. The remaining 50% of the villa rental must be settled on arrival in Cash Euros, should it not exceed the legal limit in Spain of 2500 E or paid up to 4 weeks prior to your arrival, again payable by bank transfer or by credit card.

Should you be completing a booking within 4 weeks of your arrival to Ibiza, the full amount of the villa cost will be charged to you.

Additional costs such as gas, electricity, and water are included in the villa rental price (excluding lets of two months or longer).

All payments made via credit card will incur a 3% charge as requested by our Merchant Service.

Before booking, please ensure you check the location of the villa on the map on the website advert. We accurately advertise the location of each villa. Guests are also sent a map link to the exact location with their booking confirmation. We will not be held responsible should you arrive and not be satisfied with the location. It is a reality that plane noise can be heard from some villas around the Ibiza Town and Playa d’en Bossa area, due to the town’s proximity to the airport.

Please note that there are additional fees that need to be taken into account when booking a villa through Ibiza Summer Villas. Many of them will be included in the villa cost however some do need to be paid on arrival in cash Euros:

The Eco Tax charge, which is a local government fee that each tourist has to pay on arrival. The charge is 2.20 E per person per night of your holiday.

The Cleaning charge of the villa, which starts from 300 E.

The ADW charge, which is applicable to selected villas only and further information can be found in section 7 of the General Terms and Conditions.

The prices given are always in Euros unless stated otherwise. Ibiza Summer Villas charge pro-rata on short stays. Any length of holidays are considered.

3. Early check-in and late check-out service

Where possible, we can arrange for your villa to be ready earlier than 3 pm on your day of arrival. It may also be possible to allow you to stay in your villa later than 10 am on your day of departure. This service costs 20 E per person, with a minimum charge of 80 E. If you only need to bring forward or extend your stay by only a couple of hours, the charge will be reduced.

This service is subject to availability and due to the possibility of late bookings on either side of your occupancy, we can normally only confirm an early check-in or late check-out a few days prior to your arrival or departure. For this reason, the charges for this service are to be paid in cash on arrival for early check-ins or during your occupancy for late check-outs.

If you know in advance that your flight times are problematic for the check-in or check-out times, and you want to guarantee an early entry or late departure, why not consider booking an extra night at the beginning or end of your holiday? Our Bookings Team will be happy to advise and talk through your options.

Should you be arriving on a late-night flight there is an administrative cost of 50 E for checking in after 21.00.

4. Term of Rental Accommodation

The property you have rented will be available between 15:00 – 17.00 on the day of your rental period until 10:00 am on the last day. This can vary from villa to villa. If you leave later than this time, we have the right to charge you for an extra day. The exact time of your check-in will be confirmed to you a week prior to your arrival subject to us receiving your flight information.

At the end of your holiday, you are obliged to return us the villa keys. Any loss of keys will be charged at 50 E per key. This amount varies in some villas. Should your villa have a remote control for the electric gate, a loss of this remote will cost 100 E.

The rubbish should be removed daily from the villa and put in the large bins that are provided on the roads. Upon check-in, our representative will point out the nearest place for you to deposit your rubbish. Should there be rubbish left at the villa upon your check out there will be an additional charge of 150 E.

Unless authorized in writing by Ibiza Summer Villas, you must not exceed the stipulated number of people allowed in the property. In the event that the maximum number is exceeded without prior agreement, the Property Owner reserves the right to refuse or revoke the booking at their sole discretion.

No pets are allowed without our prior written consent.

Your check-in representative will go through the rules and regulations of the villa that you are staying in. We ask that you understand in full as these rules are put in place to help you enjoy your holiday. At the arrival, the same person who has made the reservation must identify himself with the original passport and sign the check-in form, in the event that other members of the group arrive at the Villa earlier it is at Ibiza Summer Villas’s discretion the possibility of early check-in for the rest of the group members, in that case, a representative of Ibiza Summer Villas will come to the property upon arrival of the person who has made the reservation in order to sign the check-in document. The check-in document must be signed by the same person who made the reservation.

Unfortunately, Ibiza is not isolated from robberies and as a result, we have to ensure that we advise our customers to be vigilant at all times. We would suggest that you use the safe (should your villa have one) at all times, keeping your passports and money locked away. When you leave the villa during your holiday, you must lock all windows, doors, and gates securely. We would strongly suggest that you use the legalized taxis to get out and about during your holiday as opposed to the pirate taxis that can appear easier to call and quicker to use. With regards to the villa’s electricity supply, you agree not to exceed its maximum capacity by plugging electronic devices that might overload the power system.

Ibiza Summer is not responsible for the diminution of enjoyment arising in relation to matters of local engineering, construction works, or weather circumstances.

We may need access to the property during your stay for any repairs and maintenance required, but we will tell you in advance and keep any disruption to a minimum.

Whilst we do our best to ensure the accuracy of the descriptions on our website, we are not responsible for changes owners have made that we haven’t been informed about.

As part of the licensing obligations with the villas we manage, we are required by law to send all guest’s ID data to the police within 24 hours of the guest arriving at the holiday property. In addition, we are required to get each guest to sign a “parte de viajero” or guest check-in registration form. Please note that we will complete all this information upon your arrival. For any additional guests arriving during your stay, we will need to take note of their ID as well. To speed up this process especially during the peak season we will ask for your ID to be sent electronically prior to arrival.

5. Customer Behaviour

You must behave considerately towards others. If you cause unreasonable annoyance, noise, damage, crime, or danger, we have the right to evict you. You will be given a verbal warning as a first step. Should the issue continue you will be issued with a written warning. A third warning will result in eviction from the property. In serious cases, we may evict you without previous warnings.

You agree not to do anything that might jeopardize any insurance cover on the property. No parties or functions such as weddings are allowed without our prior written consent of Ibiza Summer Villas.

Any parties held without previous consent may result in the loss of your security deposit. Should speakers be hired externally, Ibiza Summer Villas will not be held responsible for any electrical shortages.

Music and any type of noise must be kept to a minimum between the hours of 00.00 and 8.00 daily. The Police can issue you with an on-the-spot fine. Ibiza Summer Villas are not negligible for this fine.

Due to recent clients’ behavior, we have no option but to introduce the following in order to protect our owners and their properties. For the period between 1 July and 15 September, all clients arriving in resort will receive a credit card link authorizing the company, Ibiza Summer Villas to charge, should there be any damage caused to the villa. The deposit will be held until your departure where it will be returned to your card without any issue. Should there be any damage to the villa we will discuss this together between the customer and the company, Ibiza Summer Villas upon check out.

This credit card authorization link will be sent to you within your Final Arrangements email that you receive a few days prior to your arrival.

The authorization amount will be set at 1500€ and this cannot be reduced.

6. The Property Owner

The Property Owner or his/her representative shall be allowed access to the holiday accommodation at any reasonable time during any holiday occupancy for the purposes of inspection and maintenance.

Dealing with problems: It is a reality that problems can occur in any property, just as they do in your own home. Ibiza Summer Villas and owners will do their utmost to maintain the property in full working order and act quickly if you find something at fault. It is a reality however that sometimes it simply isn’t possible to find a contractor or repairman on a Sunday or public holiday. Whilst Ibiza Summer Villas will help in solving any possible breakdown, failure, or malfunctioning in the property, it will not be responsible for its outcome.

7. Security Deposit

For clients arriving for shorter stays of less than a week, you are able to pay for your security deposit by credit card. Upon arrival at the villa, Ibiza Summer Villas will withhold the customer’s credit card an amount equal to the booking price as per the security deposit. We may charge you extra if the property requires excessive cleaning or rubbish removal as outlined in section 4.

Such an amount will be used to cover any possible damages or loss caused in the villa during the rental period. Once the rental period is over and Ibiza Summer Villas has checked that the villa remains free of damages or loss caused during the rental period, Ibiza Summer Villas will free the withheld amount.

In cases where the Security Deposit (SD) is required, this amount varies between 1000 Euros – 3000 Euros depending on the villa.

Should you wish to pay for the SD by PayPal this is also acceptable.

On your departure should everything in the villa be satisfactory, you will receive your security deposit in full. Please note that all the parties must vacate the property once we hand the security deposit back to you.

Should you vacate the property before one of our team is able to check the villa upon your departure. We will take photo evidence for you to view the standard of the villa. This can clearly be communicated amongst your group to alleviate any queries or concerns.

8. ADW – Accidental Damage Waiver

Regardless of the security deposit, most bookings with us will incur a non-refundable charge called an Accidental Damage Waiver (ADW). This will be added to your invoice and is payable on arrival in Cash Euros. The ADW is used to cover accidental damage that may occur at the villa and is charged at 15E per person, up to the maximum occupancy of the property. For example, should the villa sleep 10 people, then the ADW will be charged at 150E regardless. If there is a smaller group staying in a villa sleeping 10, you will be charged 150 E still. This waiver has maximum limits for damage caused to any part of the property or its facilities and excludes negligence and vandalism.

The ADW is applicable for selected villas only.

The ADW will not cover customers for willful, deliberate, or malicious damages to the villa or its contents. Nor for damages or breakages that are not reported during the customers’ occupancy of the villa. It does not cover damage to the pool, or to the cost of draining and refilling the pool due to broken glass or other items being found in the pool.

The ADW does not cover fines from the police or other island authorities incurred for any type of antisocial behavior, illegal activity, or complaints arising from noise or disturbance.

The ADW does not cover extra cleaning or rubbish removal costs if the villa is deliberately left in an excessively dirty state.

All areas that will be charged for will be documented by photo and these will be sent to you by email.

It is in your best interests to ensure that the inventory is accurate when you arrive at the villa so that any loss or damage is not wrongly attributed. We ask you to inform us of any discrepancies or malfunctions within 24 hours of arrival, after which time you will automatically be deemed to be responsible.

Any charges the company needs to make due to any of the above circumstances not covered by the ADW will be invoiced to the Lead Client after departure.

9. Booking Restrictions

Bookings cannot be accepted from persons less than 18 years of age. We reserve the right to refuse a booking without any given reason.

Our prices are those on our website unless we agree otherwise in writing. We may change website prices without notice. Once you confirm a booking or pay any deposit, you are bound to pay the full price of the property.

Not all properties on our website are available for weekly holiday rental. Some properties are available for long-term annual rental and others are for display purposes only.

10. Cancellations of Booking by the Company

We do not expect to have to make any change to your booking, although we may need to do so in relation to factors beyond our reasonable control. Such factors may include the sale or withdrawal of the property by the owner, or the property otherwise becoming uninhabitable, e.g. due to fire or flood. In such cases, we will advise you of the situation as soon as reasonably possible.

We will always make every effort to find a suitable equivalent alternative. If we are unable to find one for you, or you are unhappy with the alternative offered, we will refund in full all monies paid and shall be under no other liability.

Refunds will be given within 120 days.

11. Cancellations of Booking by the Customer

You can cancel a booking at any time. All cancellations must be advised either by email or mail. Our email address is info@ibiza-summer.com or you can write to us at Ibiza Summer Villas at Calle Riu Guadiana Nu 52, San Jose de Sa Talaia 07817, Illes Baleares, Spain. You must state the reason for the cancellation.

Cancellations must be notified to us 10 weeks before arrival. Should you within 10 weeks of your arrival, you will lose your villa deposit in full.

Should you cancel your holiday, we will proceed with the refund only if the established conditions are met. Unless the property is re-booked at full price and the Owner agrees, the booking deposit will not be refunded. We will do our best to find a replacement booking for your property, and this is often possible however not a guarantee.

Should your villa booking be affected by Force Majeure you are not entitled to a refund or compensation. Force Majeure means unusual and unforeseeable circumstances beyond the Company’s control, the consequence of which neither the Company could avoid even with all due care, including, but not limited to, war, threat of war, riot, civil strife, terrorist activity (actual or threatened), industrial dispute, unavoidable technical problems with transport, machinery or equipment, power failure, changes imposed by rescheduling or cancellation of flights by an airline, natural or nuclear disaster, fire, flood, drought, adverse weather conditions or epidemics. In order to secure a refund or compensation please contact your Insurance Company in the first instance.

We strongly recommend that you secure adequate travel insurance, which should in most cases, include cover, under certain circumstances, against loss of deposit or cancellation fees, at the time of booking.

12. COVID 19

In the event of another outbreak of Covid or the FCO suspending travel, affecting travel to and from Spain, the following conditions will apply.

Should there be no travel ban in place in Spain but you are not wishing to come to Ibiza for Summer 2021 and would like to move to Summer 2022 then we would charge a service fee of 25% and the price difference between your current stay and your new stay.

If your reservation is made under our special offer scheme whereby you the customer enjoy a special discount, the special offer will NOT be transferred to the following season. You will be offered a credit note (valid for 365 days from the date of issue) for your reservation equal to the amount of money you have paid, which can be used against any villa within the same price band. If you cannot come to Ibiza at the same time the following season your credit note can be used in other price bands.

No refunds will be offered.

Please note that any PCR Covid test or similar tests put in place to allow travel do not constitute a restriction to travel either because flight cancellations or compulsory quarantine do not constitute a restriction to travel.

From July 1, 2020, if you fly to Spain from other countries (including children of any age), it is mandatory to fill in the Health Control Form (FCS) associated with your trip, in order to present it at the Health Control of the airport of arrival in Spain. You can access the form on the website www.spth.gob.es or download the Spain Travel Health app on your mobile from the same website.

YOU SHOULD NOT TRAVEL if you have symptoms compatible with COVID-19: fever, cough, shortness of breath, with onset in the last 14 days, or if you have been diagnosed with COVID-19 in the last 14 days.

You must complete the Health Control Form on the website or the app, and from 48 HOURS before the flight, you can submit the form. Once submitted, you will receive an email with a QR code that will allow you to access the airport of destination. You can print out the code or save it on your mobile phone.

At the airport of destination, you must show the QR code that will be scanned in order to be able to access the terminal and collect your luggage.

If during your stay in Spain you have symptoms compatible with COVID-19 (fever, shortness of breath, cough) or other symptoms compatible with COVID-19 such as decreased sense of smell and taste, chills, sore throat, diarrhea, or vomiting, you should isolate yourself in your room and call the hotline for your region and in case of emergency call 112.

Ibiza Summer Villas cannot be held responsible for the quarantine costs in the event that you as the client are infected. As the client, you must pay the extra costs for each night and for losses due to Ibiza Summer Villas not being able to welcome future reservations during the quarantine period. Again we would strongly recommend that adequate travel insurance is taken out prior to your arrival.

Upon suspicion of infection by Covid-19, the client must perform the corresponding diagnostic test (PCR). If the result is positive, you must immediately inform IBIZA SUMMER VILLAS in writing, attaching the test result, and remain isolated in your room during the quarantine period established by the health authorities.

If the isolation period exceeds the rental period of the villa, the client must pay Ibiza Summer, for each extra day, the daily amount in Euros that the villa costs. Additional charges will also be applied as compensation to Ibiza Summer Villas for not being able to dispose of the villa and having an impact on the next client that is due to arrive.

In the event that the quarantine period coincides with the beginning of another reservation in the same villa, the client must pay, as compensation, the price paid for the subsequent reservation.

The foregoing, as long as there is no possibility of transfer to a tourist accommodation for tourist patients who must perform home isolation, in which case the client must leave the villa and pass the quarantine in the said center, the client has to run with all the expenses.

We are aware that this section can change at any time and we are currently waiting on the traffic travel system to be advised in the coming days from the UK Government.

13. Concierge Service

We do our best to supply the highest standard for our concierge services. However, as these services are provided by separate companies we are unable to guarantee their performance. Please provide us with as much notice as possible if you require any additional services.

14. Caution and Personal Injury

We are not responsible for personal injury to you or your party unless we have been negligent. If the negligence is that of the owner, your recourse must be against such a person.

Many of the properties have dangers such as swimming pools, dry stone walls, and unfenced drops. Please take care and caution.

Children must always be supervised, especially around the swimming pool.

The customer warrants they shall provide their own Travel and Holiday Insurance, which must be valid for the length of your holiday. Neither the property owner nor representative will be held responsible for the loss or damage of personal belongings or personal injury.

It is also worth bearing in mind that holiday properties may not always offer the same standard of comfort and furnishing as your own home. They often reflect local styles, traditions, and owners’ tastes. Comfort levels may be different, for example, kitchens may not include some equipment that is unique to your own kitchen.

If you do break or lose anything of Ibiza Summer Villas or the owner’s, you must tell us so we can arrange replacement or repair. We ask that you do not try to rectify the problem yourself.

15. Social Media

We will often send an invite to our clients to join our social media networks either before, during, or after their stay. This invitation is not obligatory to accept. On occasion, we may ask you to participate in social media activity, such as posting photos of your holiday on our Facebook page, tagging you in photos the company has taken, and posted your written testimonials online. This will never be done without your prior consent and you have every right to refuse permission.

16. Money Back Promotion

The following conditions will apply to all new bookings for 2022 booked up to and including the 31st of December. This is a promotion policy that will expire on 31 December 2022.

Free cancellation up to 60 days prior to arrival on all bookings up to and including 31 December 2022.

Shall a refund be applicable, Ibiza Summer will refund the customer within the next 120 days after receiving the cancellation notice from the customer.

For customers that booked for Summer 2021 and as a result of Covid had no option but to move their dates to Summer 2022 the following applies:

Should a travel ban be in place for Spain for your period of travel then Ibiza Summer Villas would change your dates to Summer 2023 free of charge. Your arrival date must be within the specified dates that are announced by the Government. There will be no refund given.

If you are looking to cancel your holiday however there is no travel ban in place to Spain, then you would lose your deposit or full balance.
