General Terms and Conditions

On the one hand, IBIZA SUMMER VILLAS, S.L. (hereinafter referred to as "IBIZA SUMMER VILLAS"), a limited company registered in Spain, with company number B57965170 and registered office at Calle Riu Guadiana 52, Unidad D, San Josep de Sa Talaia, 07817 Ibiza, Spain.

 

And, on the other hand, the user of the website, hereinafter referred to as the CLIENT, who accesses the WEBSITE for the purpose of obtaining information and contracting of the villas offered through the WEBSITE. The CLIENT declares that he/she is of legal age (at least 18 years old) and has the necessary legal capacity to be bound by this agreement and to use this WEBSITE in accordance with these General Terms and Conditions of Use, which he/she fully understands and accepts.

 

By using the WEBSITE, the CLIENT fully accepts all the General Terms and Conditions published on the IBIZA SUMMER VILLAS website at the time of use, and particularly those related to the limitation of liability of both IBIZA SUMMER VILLAS. The CLIENT should carefully read the General Terms and Conditions each time he/she makes a reservation, as they may have been modified since his/her last visit.

Booking Terms & Conditions

Ibiza Summer Villas is an independent company working on behalf of the owner of the property. The contract is between the owner represented by Ibiza Summer and the tenant.

 

You, our client, if there is more than one, are each responsible for all the obligations of the properties in their entirety. The client, by paying the deposit, confirms the contract and accepts these general conditions.


You agree to pass on these General Terms and Conditions to all members of your party as they govern the rental of the property and to all members of your party. The Booking Terms and Conditions are subject to change without notice. The Property Management Company may change the relevant terms and conditions, policies, or notices at any time. You acknowledge that by visiting the Website from time to time, you will be bound by the current version of the relevant terms and conditions (the "current version") and, unless otherwise stated in the current version, all previous versions will be superseded by the current version. It is your responsibility to review the current version each time you visit the Website.

When making a reservation, you, our client, will be required to pay 50% of the rental price. This deposit must be received within 24 hours of booking to secure the villa. All our prices are quoted in Euros, however, we, the company, may invoice in Pounds Sterling at our discretion.


Upon receipt of this 50% deposit, we will send you a booking confirmation by email. The remaining 50% of the villa rental must be paid ninety (90) days prior to arrival. Ibiza Summer Villas will sent the Client an email ninety (90) days prior to the arrival date with the details for payment of the pending amount (remaining balance payment). Said notice will be resent to the Client three (3) days after the first reminder. In the event that the Client fails to pay the outstanding amount within seven (7) days after the second reminder, the booking will be automatically cancelled and the villa will be put back on sale.


If the booking is made within ninety (90) days of your arrival in Ibiza, you will be charged the full amount for the villa.


When booking a villa offer (formerly referred to as a "flash sale") through our website the discount will be automatically applied to the total cost of your stay. We require 50% deposit of the original total stay cost at the point of booking and the remaining 50% balance is due ninety (90) days prior to arrival. When booking a villa offer within ninety (90) days of arrival, we require payment is full.


Utilities such as gas, electricity, and water are included in the villa rental price (except for rentals of two months or more).


Before booking, please check the location of the villa on the map in the website advert. We advertise the exact location of each villa. Guests will also receive a link to the map with the exact location along with the booking confirmation. We are not responsible if you arrive and are not happy with the location. It is a reality that aircraft noise can be heard from some of the villas around Ibiza Town and the Playa d'en Bossa area, due to the town's proximity to the airport.


Please note that when booking a villa through Ibiza Summer Villas there are additional charges to be paid. Many of these will be included in the villa cost; however, the following is payable in cash Euros upon arrival:

1. The Eco Tax, which is a local government fee that every tourist must pay on arrival. The charge is 2,20 Euros per person per night of your holiday.

2. The villa cleaning fee which starts at 300 Euros.

3. The non-refundable insurance (NRI) charge, which only applies to selected villas. You can find more information about NRI charges in "section 9".


All prices are quoted in Euros unless otherwise stated. Ibiza Summer Villas charges pro rata for short stays. Any length of holiday is considered.

 

Our standard check in times are from 15:00 and our standard check out time is 10:00. Please note that on the day of your departure our cleaners will enter the grounds from 9am to start cleaning the exterior. They will not enter the villa until the 10am check out time. 


We cannot guarantee an early check-in, but where possible, depending on availability, we can arrange for your villa to be ready before 15:00 on the day of your arrival. Depending on the availability of the villa, it may also be possible for you to stay in your villa later than 10:00 on the day of departure. There is additional costs for a late check-out which varies per villa.

 

This service is subject to availability and due to the possibility of late bookings on both sides of your stay, we can normally only confirm an early check-in or late check-out a24-48 hours prior to your arrival or departure. For this reason, charges for this service must be paid in cash upon arrival for early check-ins or during your stay for late check-outs.


If you know in advance that your flight schedule will affect your check-in or check-out times, and you would like to guarantee an early check-in or late check-out, we strongly recommend that you book an extra night at the beginning or end of your holiday. Our reservations team will be happy to advise you and explain your options.

 

If you are arriving on a night flight, there is an administrative charge of 80 Euros for check-in after 21.00.

The property you have rented will be available between 15:00 and 17:00 on the first day of your rental period until 10:00 on the last day. This may vary from villa to villa. If you check out after this time, we reserve the right to charge you for an extra day. The exact check-in time will be confirmed with you one week before your arrival, subject to receipt of your flight details.

 

At the end of your holiday, you must return the villa keys to us in person at the villa. Under no circumstances may you leave the villa without first informing the IBIZA SUMMER VILLAS representative who handed you the keys of your intention to bring forward your departure date. Any loss of keys will be charged at 50 Euros per key. This amount varies depending on the villas. If your villa has a remote control for the electric gate, the loss of the remote control is charged at 100 Euros.


Rubbish must be removed from the villa daily and deposited in the large bins on the street. When you check-in, our representative will show you the nearest place to dispose of your rubbish. If rubbish is left in the villa on departure there will be an additional charge of 200 Euros.

 

You must not exceed the stipulated number of persons allowed in the property without written permission from IBIZA SUMMER VILLAS. If the maximum number is exceeded without prior agreement, the owner reserves the right to refuse or cancel the booking at their sole discretion.

 

Pets are not allowed without our prior written consent.

 

Your IBIZA SUMMER VILLAS representative will explain the rules and regulations of the villa you are staying in. Please make sure you fully understand these rules as they have been put in place to help you enjoy your holiday. On arrival, the same person who has made the booking must identify themselves with their original passport and sign the registration document, in the event that other members of the group arrive at the villa earlier, it is at the discretion of IBIZA SUMMER VILLAS to make an early check-in for the remaining members of the group, in which case a representative of Ibiza Summer Villas will come to the property on the arrival of the person who has made the booking to sign the registration document. The check-in document must be signed by the same person who made the booking.

 

Unfortunately, Ibiza is not immune to burglary and we must advise our guests to be vigilant at all times. We recommend that you always use the safe (if your villa has one) and keep your passports and money under lock and key. When leaving the villa during your holiday, you should lock all windows, doors, and gates. We strongly recommend that you use legal taxis to get around during your holiday, rather than pirate taxis, which may seem easier to hail and quicker to use. With regard to the villa's electricity supply, you agree not to exceed the maximum capacity by plugging in electronic devices that may overload the electrical system. IBIZA SUMMER VILLAS is not responsible for the loss of objects or money left in the villa during the CLIENT's stay, whether due to theft, robbery or any other reason.

 

IBIZA SUMMER VILLAS cannot be held responsible for any loss of enjoyment due to local technical problems, construction work, theft or weather conditions.

 

We may need to access the property during your stay to carry out any necessary repairs or maintenance, but we will inform you in advance and keep any disruption to a minimum.

 

Whilst we make every effort to ensure the accuracy of the descriptions on our website, we cannot be held responsible for any changes made by the owners of which we have not been informed.

 

As part of our licensing obligations with the villas we manage, we are required by law to send all identifying details of guests to the police within 24 hours of the guest's arrival at the holiday property. In addition, we are required to have each guest sign a "traveller's form" or guest check-in form. Please note that we will complete all of this information on arrival. For any additional guests arriving during your stay, we will also need to record their identification. To speed up this process, especially during peak season, we will ask you to send us your ID electronically prior to your arrival.

You must be considerate of others. If you cause unwarranted disturbance, noise, damage, offence or danger, we have the right to evict you. As a first step, you will receive a verbal warning. If the problem persists, you will be given a written warning. A third warning will result in eviction from the property. In serious cases, we may evict you without prior warning.

 

You agree not to do anything that could jeopardise the insurance cover of the property.

 

In particular, it is strictly forbidden to use the villas for any purpose other than the CLIENT’s holiday accommodation. In particular, it is forbidden to take videos or pictures of the villa for commercial purposes or to hold parties or events such as weddings. Any activity other than that of holiday accommodation requires the prior written consent of Ibiza Summer Villas.

 

Any of the above events held without prior consent may give rise to the right of eviction from the villa, and consequently the loss of the balance paid, without prejudice to the right of Ibiza Summer Villas to claim damages arising from the CLIENT's actions. In the event of hiring external speakers, Ibiza Summer Villas cannot be held responsible for possible power cuts.

 

Under no circumstances can guests hold any event, party or gathering at any point throughout the day or night. We cannot allow guests to arrange for a DJ to play music at any of our villas; nor can we allow external DJ or sound systems to be brought into the villa premises. There is a law in Ibiza stipulating that playing loud music or making excessive noise between the hours of 23:00 and 08:00 is forbidden. The police can impose an on-the-spot fine. Ibiza Summer Villas is not responsible for paying this fine.

 

Due to the recent behaviour of guests, we have no choice but to introduce the following policy to protect our owners and their property. For the period between 1st July and 15th September, clients arriving at the villas where the security deposit applies will receive a credit card link authorising the company, Ibiza Summer Villas to collect the deposit in the event of any damage to the villa. The security deposit will be kept until your departure, when it will be returned to your card without any problem. In the event of any damage to the villa, this will be discussed jointly between the client and Ibiza Summer Villas at the time of departure.


Equally, guests must be respectful of the COMPANY team members. Any rude, disrespectful, abusive or threatening behaviour will not be tolerated.

The Owner or his representative shall have access to the holiday accommodation at all reasonable times during the holiday occupation for inspection and maintenance purposes.

It is a reality that problems can arise in any property, just as they can in your own home. Ibiza Summer Villas and the owners will make every effort to keep the property in perfect condition and will act promptly if you find anything untoward. However, the reality is that sometimes it is simply not possible to find a contractor or repairer on a Sunday or public holiday. Whilst Ibiza Summer Villas will assist in rectifying any possible breakdowns, faults or malfunctions in the property, Ibiza Summer Villas cannot be responsible for the outcome.

The security deposit (SD) applies to selected villas only. In cases where the Security Deposit is required, the amount varies between 1,500 Euros - 4,000 Euros depending on the villa.

 

On arrival at the villa, Ibiza Summer Villas will hold the Security Deposit amount on the client credit card. We may charge an additional amount if the property requires excessive cleaning or rubbish removal as outlined in section 4. 

 

This amount will be used to cover any damage or loss caused to the villa or its property during the rental period. Guests are informed before arrival that all our properties are in residential areas and therefore, all guests must be respectful of neighbours who live in close proximity and adhere to both our tenancy rules, as well as the local laws regarding noise and capacity levels. Any complaints from neighbours or police will result in a partial or complete loss of your security deposit which will be at the discretion of Ibiza Summer Villas depending on the level of damage, noise or behaviour. If a guest receives a on-the-spot fine from the police or the town hall, Ibiza Summer Villas are not liable for this fine.


Any complaints we receive about guest behaviour whilst staying in one of our villas will result in a two-step warning process. If we are forced to send you a second warning, this will result in either a partial or complete loss of your security deposit, and in some cases, eviction without refund or reimbursement of any kind.


Once the rental period has ended and Ibiza Summer Villas is satisfied that there has been no damage or loss to the villa during the rental period, Ibiza Summer Villas will release the security deposit.

 

Please note that all parties must vacate the property once we return the security deposit to you.

 

Should you vacate the property before one of our team is able to check the villa on your departure. We will take photos so that you can check the condition of the property. This can be clearly communicated amongst your party to alleviate any doubts or concerns.

NRI applies to selected villas only. Irrespective of the security deposit, most bookings with us are subject to a non-refundable charge called the Non-Refundable Villa Insurance (NRI), which will be added to your invoice and is payable on arrival in cash in Euros. The NRI is designed to cover accidental damage that may occur to the villa and is charged at a fixed cost per villa which can vary between €200 and €400 depending on the standard of each villa. This insurance has maximum limits for damage caused to any part of the property or its facilities.


The NRI does not cover damage from client negligence or vandalism; nor does it cover clients for wilful, deliberate or malicious damage to the villa or its contents. It also does not cover damage or breakages that are not reported during the client's stay in the villa. It does not cover damage to the swimming pool, nor does it cover the cost of emptying and refilling the pool due to broken glass or other objects found in the pool.


The NRI does not cover fines imposed by the police or other island authorities for any form of anti-social behaviour, illegal activity or noise or nuisance complaints.


The NRI does not cover additional cleaning or rubbish collection costs if the villa is deliberately left in an excessively dirty state.


All areas to be charged for will be photographed and emailed to you.


It is in your best interest to ensure that the inventory is accurate when you arrive at the villa so that any loss or damage is not incorrectly attributed. Please notify us of any discrepancies or damage within 24 hours of arrival, after which you will automatically be held responsible.


Any charges incurred by the company due to any of the above circumstances which are not covered by the NRI will be invoiced to the client after departure.

Bookings will not be accepted from anyone under the age of 21. We reserve the right to refuse a booking without justification.

Our prices are those shown on our website unless otherwise agreed in writing. We may change the prices on the website without notice. Once you have confirmed a booking or paid a deposit, you are obliged to pay the full price of the property.

 

Not all properties on our website are available for weekly holiday rentals. Some properties are available for long term annual rental and others are for show purposes only.

We do not expect to have to make any changes to your booking, although we may have to do so in relation to factors beyond our reasonable control. Such factors may include the sale or withdrawal of the property by the owner, or the property becoming uninhabitable, for example, due to fire or flood. In such cases, we will inform you of the situation as soon as reasonably possible.

 

We will always do our best to find a suitable equivalent alternative. If we are unable to find you an alternative or if you are not satisfied with the alternative offered to you, we will refund you in full and assume no further liability.

 

Refunds will be made within 120 days. 

You can cancel a booking at any time. All cancellations must be made by email or post. Our e-mail address is info@ibiza-summer.com or you can write to us at Ibiza Summer Villas at Calle Riu Guadiana Nu 52, San Jose de Sa Talaia 07817, Illes Baleares, Spain. You must state the reason for the cancellation.

 

Cancellations made ninety (90) days prior to the arrival date will result in the loss of the deposit.


If you cancel your holiday, we will only refund if the conditions are met. Unless the property is rebooked at full price and the owner agrees, the booking deposit will not be refunded. We will endeavour to find a replacement booking for your property, and this is often possible but it is not guaranteed.

 

If your villa booking is affected by force majeure, you will not be entitled to any refund or compensation. Force majeure means any unusual and unforeseeable circumstance beyond the Company's control, the consequences of which the Company could not reasonably avoid, including, but not limited to war, threat of war, riot, civil strife, terrorist activity (actual or threatened), industrial disputes, unavoidable technical problems with transport, machinery or equipment, power failure, changes due to the rescheduling or cancellation of flights by an airline, natural or nuclear disasters, fire, flood, drought, adverse weather conditions, theft or epidemics. To obtain a refund or compensation, please contact your insurance company.

We strongly recommend that you take out appropriate travel insurance at the time of booking, which, in most cases, includes cover for loss of deposit or cancellation fees in certain circumstances.

Free cancellation up to ninety (90) days prior to arrival date.

 

In the event of a refund, IBIZA SUMMER VILLAS will reimburse the client within one hundred and twenty (120) days of receipt of the cancellation notice from the client. 

If you wish to cancel a booking less than 90 days prior to the date of arrival at the villa, you will be charged the deposit paid to date. If you have paid the full amount of the booking, no refunds will be made under any circumstances.

We endeavour to provide the highest standard of concierge services. However, as these services are provided by independent companies, we cannot guarantee their performance. Please let us know as far in advance as possible if you require any additional services. Under no circumstances will IBIZA SUMMER VILLAS be liable for any damage or consequences caused by third party services.

We are not liable for personal injury suffered by you or your companions unless we have been negligent. If the negligence is that of the owner, your recourse must be against that person.


Many of the properties have hazards such as swimming pools, dry stone walls and unfenced slopes. Please take care and exercise caution.Children should be supervised at all times, especially around the pool.

The client guarantees to have their own travel and holiday insurance valid for the duration of their holiday. Neither the owner nor his representative shall be liable for any loss or damage to personal property or personal injury.

 

It is also important to remember that holiday homes do not always offer the same level of comfort and furnishings as your own home. They often reflect local styles, traditions and the tastes of the owners. The level of comfort may be different; for example, kitchens may not include some of your own kitchen equipment.

 

If you break or lose anything belonging to Ibiza Summer Villas or the owner, you must let us know so that we can arrange for its replacement or repair. Please do not attempt to fix the problem yourself.

We will often send an invitation to our guests to join our social media before, during or after their stay. It is not mandatory to accept this invitation. Occasionally, we may ask you to take part in social media activities, such as posting photos of your holiday on our Instagram page, tagging you in photos taken by the company and posting your written testimonials online. This will never be done without your prior consent and you have every right to refuse consent.

In the event of another outbreak of Covid or any other disease (epidemic, pandemic, etc.) that makes travel impossible and affects travel to and from Spain, the following conditions will apply.

In the event that there is no travel ban to Spain, but you do not wish to come to Ibiza on the requested dates and wish to transfer to the next summer, we will charge you a service fee of 25% and the difference between your current stay and the price of your new stay.


If your booking was made under our special offer programme, which gives you a special discount as a client, the special offer will NOT be transferred to the following season. You will be offered a credit note for you booking (valid for 365 days from the date of issue) for the amount paid, which can be used for any villa within the same price range. If you are unable to come to Ibiza at the same time in the following season, your credit note can be used in other price ranges.

No refunds will be given.


You MUST NOT TRAVEL if you have symptoms compatible with COVID-19 or any other illness that could lead to restrictions on your mobility being imposed by the authorities.

 

Ibiza Summer Villas will not be responsible for quarantine costs should you, as a client, become infected. As a client, you will be responsible for the additional cost of each night and any losses incurred as a result of IBIZA SUMMER VILLAS not being able to accommodate future bookings for the duration of the quarantine period. Once again, we strongly recommend that you take out adequate travel insurance before you arrive.

 

If infection is suspected, the client must undergo the appropriate diagnostic test (PCR). If the result is positive, you must immediately notify IBIZA SUMMER VILLAS in writing, enclosing the test result, and remain isolated in your room for the quarantine period established by the health authorities.

 

If the quarantine period exceeds the rental period of the villa, the client must pay Ibiza Summer, the daily rate in Euros for the villa for each additional day. Any additional costs will also be paid as compensation to Ibiza Summer Villas for not being able to rent the villa and will be passed on to the next client who is due to arrive.

 

In the event that the quarantine period coincides with the commencement of another booking in the same villa, the client shall pay the price of the subsequent booking as compensation.

 

Ibiza Summer Villas will not be responsible for quarantine costs should you become infected as a client. As a client, you will be responsible for the additional cost of each night and any losses incurred as a result of IBIZA SUMMER VILLAS being unable to accommodate future bookings during the quarantine period. Again, we strongly recommend that you take out adequate travel insurance before you arrive.

 

If infection is suspected, the client must undergo the appropriate diagnostic test (PCR). If the result is positive, you must immediately inform IBIZA SUMMER VILLAS in writing, enclosing the test result, and remain isolated in your room for the quarantine period set by the health authorities.

 

If the quarantine period exceeds the rental period of the villa, the client must pay Ibiza Summer the daily rate in Euros for the villa for each additional day. Any additional costs will also be charged to Ibiza Summer Villas as compensation for not being able to rent the villa and will be passed on to the next client.

 

Should the quarantine period coincide with the commencement of another booking in the same villa, the client shall pay the price of the subsequent booking as compensation.

 

The aforementioned will apply if there is no possibility of transfer to a tourist accommodation for tourist patients who must be quarantined. Otherwise, the client will have to leave the villa and spend the quarantine period at the said centre, at the client's expense.
